Judicial precedent

Spanish version

One of the objectives of the Center for Constitutional Studies is to study the precedents of the Supreme Court of Justice of the Nation. The purpose of this line of research is the critical review of the processes of creation, change, publication and follow-up of the jurisprudence of the Supreme Court, as well as isolated judicial precedents. The study of the aspects described above is carried out through the theories of the precedent in comparative law, through the changes that have been generated from the opening of the Mexican legal system to international human rights law and through empirical evidence obtained from decisions of the Supreme Court and courts linked by their jurisprudence.

Likewise, at the Center we have designed a methodology for the formulation of jurisprudential lines that adapts to the precedent system of the Supreme Court. Currently, we are working on the formulation of jurisprudential lines applying this methodology. The purpose of this project is to adequately disseminate the criteria of the Supreme Court of Justice of the Nation among judges, public officials, litigants, academics, law students and those interested in monitoring and studying the judicial precedent of the highest court in the country.
